Terms of Sales.
These General Terms and Conditions of Sale (hereinafter the "GTC") are issued by Work with Island, a simplified joint-stock company (société par actions simplifiée) with a share capital of €1,012,578, registered with the Bobigny Trade and Companies Registry under number 845 369 495, with its registered office at 5 rue Pleyel, Saint-Denis (93200) (hereinafter "WORK WITH ISLAND").
WORK WITH ISLAND offers to individuals or legal entities acting in a professional capacity (hereinafter the "Customers") the sale of acoustic office phone pods and meeting rooms (hereinafter the "Equipment" or the "Products").
The Equipment offered by WORK WITH ISLAND is presented on its website, operated as part of its business activity and accessible at the URL https://workwithisland.com (hereinafter the "Website").
ARTICLE 1 - SCOPE AND ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS OF SALE
These GTC are intended to define the terms and conditions for ordering, delivering and installing the Equipment. They apply, without restriction or reservation, to any order for Equipment placed by a Customer with WORK WITH ISLAND. They are provided to the Customer when a quote is submitted. The Customer is informed that by signing the quote, they accept these GTC, which are available on the website www.workwithisland.com or, for online orders, before the shopping cart is confirmed.
Unless otherwise agreed in writing by the parties, these GTC take precedence over any conflicting clauses from previously drafted general conditions or from the Customer's own general purchasing conditions.
WORK WITH ISLAND reserves the right to modify and/or update these GTC at any time. Only the version accepted on the date the Customer places their order applies to and is binding on that Customer.
The fact that WORK WITH ISLAND does not invoke any provision of these GTC at any given time cannot be interpreted as a waiver of its right to do so at a later date.
ARTICLE 2 - PRODUCT PRESENTATION
WORK WITH ISLAND undertakes to describe its products as accurately as possible in its product descriptions and across the various sections of the website www.workwithisland.com. Should any errors or omissions be identified in these presentations or product descriptions, WORK WITH ISLAND's liability cannot be engaged on that basis.
Photographs and illustrations are also not part of the contractual scope.
ARTICLE 3 - ORDER
WORK WITH ISLAND provides a free quote to any Customer who requests one.
An order is finalised upon acceptance of the Customer's purchase order by WORK WITH ISLAND, or upon acceptance of WORK WITH ISLAND's quote by the Customer.
Orders are firm and final from the moment the purchase order is signed by WORK WITH ISLAND or the quote is signed by the Customer. No order cancellation will be accepted.
For orders placed online on the website www.workwithisland.com, before confirming their order, the Customer has the opportunity to review the details of their draft order and correct any errors. The distance sales contract is concluded from the moment the Customer confirms their order by clicking the "Click to sign" button.
The Customer is deemed to have knowingly accepted the content and conditions of the order, and in particular these General Terms and Conditions of Sale, the fact that their order implies a payment obligation, as well as the prices, volumes, specifications, quantities and delivery times of the products offered for sale and purchased.
Once this step has been completed, the Customer can no longer cancel their order, which is considered firm and final. The order will be confirmed to the Customer by email. A further email will inform them of the dispatch date.
WORK WITH ISLAND recommends that the Customer keeps their emails on paper or digital format. The Customer is informed that emails are sent to the email address provided by the Customer. Accordingly, in the event of an error in the email address entered, or if the order confirmation email is not received, WORK WITH ISLAND's liability cannot be engaged.
WORK WITH ISLAND reserves the right to refuse any order of an abnormal or excessive nature.
If an order is confirmed for a product that turns out to be unavailable at the time of delivery, WORK WITH ISLAND undertakes to notify the Customer and to propose a new delivery date as soon as possible, or a refund within a maximum of two business days following the cancellation request.
ARTICLE 4 - DELIVERY COUNTRIES
Products sold by WORK WITH ISLAND can be shipped to the following countries: metropolitan France, Belgium, Switzerland, Luxembourg, Spain, United Kingdom, the Netherlands, Portugal (hereinafter the "Countries").
Equipment cannot be delivered outside metropolitan France (excluding coastal islands not connected by road).
If individuals located in a country other than the Countries listed wish to place an order on the website www.workwithisland.com, we recommend they contact our Customer Service to find out the applicable price and delivery terms and conditions.
ARTICLE 5 – PRICING
Prices listed on the website www.workwithisland.com are in euros, excluding taxes, and include shipping and logistics costs for deliveries to metropolitan France, Belgium, Spain, Luxembourg and Switzerland. Delivery rates apply to deliveries made Monday to Friday.

WORK WITH ISLAND reserves the right to modify its prices without notice and at any time. Invoicing is carried out at the rate in effect at the time the order is recorded and accepted.
In the case of delivery outside the European Union or to French overseas territories, the Customer is considered the official importer and is responsible for complying with the regulations of the country of destination. Any applicable taxes and customs duties due upon arrival of the package are the Customer's sole responsibility. We are not required to provide the amount of such duties and taxes.
ARTICLE 6 – DELIVERY
6.1 Delivery conditions
Delivery is carried out by making the Equipment available at the address provided by the Customer when placing their order.
The Customer is responsible for the accuracy and completeness of the information they provide to WORK WITH ISLAND to enable the assembly and delivery of the Equipment under the best possible conditions. The Customer must also provide WORK WITH ISLAND with easy access to the premises and to the location where the Equipment will be installed.
Delivery times indicated on the website are average times observed for dispatch and delivery, expressed in calendar days, and do not constitute a contractual commitment. WORK WITH ISLAND's liability cannot under any circumstances be engaged in the event of a delay in Equipment delivery.
The Customer is required to check the apparent condition of the Equipment upon delivery. If any anomaly or malfunction is identified at the time of delivery, the Customer must inform WORK WITH ISLAND as soon as possible. In any event, the Customer has 48 (FORTY-EIGHT) hours (excluding non-working days and public holidays) from receipt of the Equipment to submit written reservations to WORK WITH ISLAND. If the Customer fails to comply with these formalities, no claim can be accepted by WORK WITH ISLAND. Furthermore, in the absence of any reservations expressly made by the Customer at the time of delivery, the Equipment delivered by WORK WITH ISLAND is deemed to conform in quantity and quality to the order placed by the Customer.
6.2 Cancellation or postponement of deliveryn
If the Customer cancels or postpones the delivery less than forty-eight (48) working hours before the agreed date, they may be subject to penalties equivalent to the delivery costs. These penalties will be invoiced by WORK WITH ISLAND as an additional charge, without prejudice to the company's right to claim compensation for any further loss.
ARTICLE 7 - PAYMENT
7.1. Payment methods
Payment for purchases is made by bank transfer to the bank account designated by WORK WITH ISLAND.
For orders placed online on the website www.workwithisland.com, payment is made by credit or debit card (CB, Visa, Mastercard, American Express) via our partner STRIPE, or in 4 instalments via our partner ALMA.
Certain other payment methods, such as bank transfers, may be accepted, but the Customer's order will only be dispatched once the full payment amount has been received. To pay by bank transfer, follow the procedure after entering your delivery information.
Full payment is a prerequisite for order processing
7.2. Payment verification
In order to protect against fraud, the WORK WITH ISLAND team reviews each order placed.
To this end, and before your order is dispatched, WORK WITH ISLAND reserves the right to request any documents necessary to verify your identity or delivery address (identity document, company registration certificate, proof of address, etc.).
These documents are requested by phone or email, in particular for all new customers.
7.3. Payment security
Payment security is provided by our partners STRIPE and ALMA, among the world's leading providers of card payment processing. These services incorporate the SSL security standard. No confidential data (card number, expiry date or three-digit security code) is stored on WORK WITH ISLAND's servers. This data is transmitted directly in encrypted form to our partners' servers.
STRIPE and ALMA are electronic payment service providers and issue an electronic certificate that serves as proof of the amount and date of the transaction, in accordance with Articles 1365 et seq. of the French Civil Code.
7.4. Late payment
Unless otherwise agreed, the sale price is payable at the time of order.
No discount is granted for early payment.
Any failure to pay or late payment of amounts owed by the Customer on the due date shall automatically result, without prior formal notice and without prejudice to any damages, on the day following the payment date shown on the invoice, in a late payment penalty becoming due to WORK WITH ISLAND, calculated at an interest rate of 10%.
In this case, the Customer shall also automatically be liable for a flat-rate recovery fee of forty (40) euros, in accordance with Article D.441-5 of the French Commercial Code, unless the costs incurred exceed this amount.
WORK WITH ISLAND reserves the right to suspend or cancel the execution of any order and/or delivery, regardless of its nature or stage of completion, in the event of non-payment or partial payment of any amount owed by the Customer, in the event of a payment incident, or in the event of fraud or attempted fraud in connection with the use of the Website.
Products remain the property of WORK WITH ISLAND until full payment of the price has been received.
ARTICLE 8 - RETURNS AND REFUNDS
8.1 Eligibility for the 100-day trial
Unless otherwise specified, all orders are eligible for a 100-day trial, corresponding to a return period of 100 calendar days. The free 100-day trial applies only to the first product ordered within a given category.
Where the Customer has already returned a product in the same category, they are no longer entitled to the free trial. Products ordered again cannot be collected by WORK WITH ISLAND and no refund can be issued.
The 100-day trial offer does not apply to orders subject to a leasing or financing agreement with a third party.
8.2 Return conditions
The Customer may exercise their right of return within 100 calendar days from the date of receipt of their first order.
To exercise this right, the Customer must contact WORK WITH ISLAND (see contact details on the website www.workwithisland.com).
Once the Customer has contacted WORK WITH ISLAND to exercise their right of return, WORK WITH ISLAND will get in touch to arrange the collection of the Product(s).
Return shipping costs are fully covered by Work With Island for the first Product.
The original packaging is required for the return.
Returned Products must show only signs of normal use and must not be damaged. WORK WITH ISLAND reserves the right to request photographs before the return takes place. Products showing, for example, significant staining cannot be returned or refunded.
8.3 Refund of returned items
WORK WITH ISLAND will process the refund for returned Equipment within 30 days of receiving said Equipment.
Any damaged Equipment that was not subject to express remarks or reservations by the Customer at the time of delivery will be refused.
ARTICLE 9 - PRODUCT WARRANTY
Products sold by WORK WITH ISLAND are covered by a 5-year warranty from the invoice date, against any operating defect resulting from a material, manufacturing or design fault.
To benefit from the warranty, the Customer must notify WORK WITH ISLAND without delay of any defects claimed and provide WORK WITH ISLAND with a copy of the Equipment purchase invoice.
Based on the documents and information provided, WORK WITH ISLAND's Customer Service will determine whether the issue is covered by this contractual warranty.
If a manufacturing defect is confirmed, WORK WITH ISLAND will repair or replace the defective Equipment at its own expense.
The Equipment must be in good condition and clean.
Regarding the replacement of parts, Work with Island undertakes to supply spare parts for up to two years after the end of series production of the product concerned.
ARTICLE 10 - LIABILITY
WORK WITH ISLAND and the Customer each ensure the proper performance of the contract binding them, and each assumes responsibility for the consequences arising from their own faults, errors or omissions that cause direct harm to the other party.
10.1 Customer's liability
The Customer is solely responsible for the quality, accuracy, relevance and completeness of the information provided to WORK WITH ISLAND for the placement, validation, delivery and assembly of their Equipment order. WORK WITH ISLAND's liability cannot be engaged on this basis.
The Customer undertakes to be present on the day of pod installation. If delivery cannot take place on the scheduled day due to an unannounced absence, the cancelled service will be invoiced. A new delivery will be arranged and invoiced accordingly.
10.2 WORK WITH ISLAND's liability
WORK WITH ISLAND implements all necessary measures to provide the Customer, under the best possible conditions, with quality Equipment that conforms to what was ordered.
WORK WITH ISLAND's liability cannot be engaged for any inconvenience or damage inherent to the use of the internet and outside the precautions taken by the company.
WORK WITH ISLAND is only required to compensate for material damages caused to the Customer that result from faults attributable to WORK WITH ISLAND in the performance of the contract binding them. In particular, WORK WITH ISLAND cannot be held liable for any loss suffered by the Customer as a result of installation and/or assembly not carried out in accordance with industry standards by a third-party technician or contractor.
WORK WITH ISLAND cannot be held liable to any party for any indirect damages, loss of business, profit or revenue, arising in any manner whatsoever, even if such damage or loss was foreseeable or if the possibility of such damage had been brought to WORK WITH ISLAND's attention.
Should WORK WITH ISLAND's liability be engaged, it shall not exceed the total amount, inclusive of all taxes, paid by the Customer for the order in connection with which the disputed damage occurred.
ARTICLE 11 - FORCE MAJEURE
Force majeure is defined as any event beyond the control of either party that could not reasonably have been foreseen at the time the contract between WORK WITH ISLAND and the Customer was entered into. Such an event is characterised when the party affected by it is prevented from properly fulfilling its contractual obligations, despite the implementation of adequate and appropriate measures to limit its effects.
Neither party shall be held liable to the other for the non-performance or delay in performance of any obligation arising from these GTC where such non-performance or delay results from the other party's actions following the occurrence of a force majeure event, as recognised and defined by French case law.
A force majeure event suspends the obligations arising from these GTC for the entire duration of its existence. During this period, neither party may validly invoke the existence of such an event within the meaning of Article 1218 of the French Civil Code to justify the termination of their contractual relationship with the other party. However, if the force majeure event lasts for more than thirty (30) consecutive days, either party shall have the right to terminate these GTC by operation of law, eight (8) days after sending a registered letter with acknowledgement of receipt notifying this decision.
ARTICLE 12 - INTELLECTUAL PROPERTY
All images, photographs, illustrations and designs, as well as texts and comments reproduced on the website www.workwithisland.com, are protected by copyright, trademark law and image rights, worldwide.
This content published on the website www.workwithisland.com is the sole and exclusive property of WORK WITH ISLAND.
Any unauthorised use constitutes an act of infringement and is subject to sanctions under intellectual property law.
No transfer of any intellectual property right to the Customer may be inferred from the performance or interpretation of the contract entered into with WORK WITH ISLAND. Total or partial reproduction of the website www.workwithisland.com is strictly prohibited.
Any link to the website www.workwithisland.com or any of its satellite sites, even if tacitly authorised, must be removed upon simple request from WORK WITH ISLAND.
ARTICLE 13 - YOUR LOGO
By ordering one or more Products and accepting these General Terms and Conditions of Sale, you authorise WORK WITH ISLAND to display your company name and/or logo on its physical and digital communication materials.
ARTICLE 14 - PERSONAL DATA
When you browse www.workwithisland.com and use the online sales services available on the website, personal data relating to you is collected and processed by our teams. To find out more, please consult our Privacy Policy.
ARTICLE 15 - DISPUTE RESOLUTION
These GTC are governed by French law.
In the event of a dispute arising from the placement, performance, execution or termination of an order, or more generally in the context of the commercial relations between the parties, the competent court shall be the Paris Commercial Court.
